1. About this policy

This Privacy Policy explains how William Garske trading as MisfloAI, ABN 90 654 262 069 (MisfloAI, we or us) collects, uses, stores and discloses personal information. We are based in Sydney, Australia.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy applies to:

  • people who visit our website or contact us;
  • businesses that buy a MisfloAI plan (our clients) and the people who work for them; and
  • people who call one of our clients and receive an automated text from MisfloAI on that client’s behalf (callers).

2. What we collect

When you buy a plan or contact us, we collect your name, business name, type of business, phone number, email address, the plan you choose, and anything you tell us in a message, email or phone call.

Accounts. If you sign up or log in with Google, Apple, Microsoft or Yahoo, that provider shares your name and email address with us. We never see your password for those accounts.

Payment information. Payments are processed by Whop. We do not see or store your full card number. Whop shares limited billing information with us, such as your Whop membership and payment IDs, your name and email address, subscription status and payment history.

Service information. To provide MisfloAI, we collect the business phone numbers you connect, your message settings, and records of missed calls, texts sent and replies received.

Caller information. When someone calls a client and the call is missed, we collect the caller’s phone number, the time of the call, and any text replies they send (which may include their name, suburb or address, and details of the job or appointment they need). See section 5.

Website information. Like most websites, our hosting provider automatically records basic technical information such as IP address, browser type and the pages requested, for security and to keep the site working.

We do not ask for sensitive information (such as health information). Please don’t include it in messages to us. If a caller volunteers it in a text reply, we only use it to pass the enquiry on to the business they contacted.

3. How we collect it

We collect information directly from you when you fill in our order form, pay through Whop, email or call us, or use the service. We collect caller information when callers contact our clients and reply to our automated texts. We also receive information from our service providers, such as Whop and Twilio.

You don’t have to give us your personal information, but if you don’t, we may not be able to provide the service or respond to you.

4. How we use it

We use personal information to:

  • set up, provide, support and improve MisfloAI;
  • send automated texts to callers on behalf of our clients, and send clients their summaries and reports. Replies and summaries are written by an AI model (see section 8);
  • process payments, issue receipts and manage subscriptions;
  • respond to questions, support requests and complaints;
  • keep our service and website secure, and prevent spam, fraud and misuse; and
  • meet our legal obligations, such as tax record-keeping.

We do not sell personal information, and we do not use it for any purpose unrelated to the above.

5. Information about our clients’ callers

If you received a text from MisfloAI, it was sent on behalf of the business you called. That business is our client, and the information you send in reply belongs to them. We use it only to:

  • pass your enquiry on to that business so they can call you back;
  • show the business a history of the conversation; and
  • keep the service secure and working, and meet our legal obligations.

We do not use callers’ information to market to them, and we do not share it with any business other than the one they called. Each client is responsible for how they use your information once they receive it, under their own privacy obligations.

If you have a question about a message you received, you can contact the business directly, or contact us and we will help.

6. Text messages and opting out

Every automated text identifies the business it is sent for and tells you how to opt out. Reply STOP at any time and you won’t receive further automated texts from that business through MisfloAI. We action opt-outs as soon as practicable, and in any case within 5 business days, as required by the Spam Act 2003 (Cth). We keep a record of opt-outs so we can respect them.

7. Marketing from us

If you contact us or buy a plan, we may send you information about MisfloAI, such as service updates or new features. Every marketing email or text we send includes a way to unsubscribe, and you can also ask us to stop at any time by emailing MisfloAI@gmail.com. We will still send you messages about your account, billing and the service itself.

8. Who we share it with

We only share personal information with:

  • Whop, to process payments and manage subscriptions;
  • Twilio, our phone and SMS provider, to receive forwarded calls and send and receive text messages;
  • Anthropic, whose Claude AI model writes our automated replies and the summaries we send to clients. Anthropic processes the conversation text to do this and, under its commercial terms, does not use it to train its models;
  • Railway, which hosts our website and database;
  • Google (Gmail), which we use for email, including order notifications;
  • the client business a caller contacted (for caller information only);
  • our professional advisers, such as accountants and lawyers, where needed; and
  • government bodies or others where required or authorised by law.

Our service providers may only use the information to provide services to us, and are required to protect it.

9. Overseas disclosure

Some of our service providers store or process information outside Australia. In particular, Whop, Google, Railway, Twilio and Anthropic may store or process information in the United States and other countries where they operate.

We take reasonable steps to make sure these providers handle personal information in a way that is consistent with the Australian Privacy Principles, including by using established providers with published security and privacy commitments.

10. Cookies and website data

Our website does not use advertising or tracking cookies, and we don’t currently use analytics tools. Your browser may store small amounts of information needed for the site to work. When you pay, Whop’s checkout page uses its own cookies for security and fraud prevention, as described in Whop’s privacy policy.

If we add analytics or other cookies in future, we will update this policy first.

11. How we protect it

We take reasonable steps to protect personal information from misuse, loss and unauthorised access, including:

  • encrypting data sent to and from our website (HTTPS);
  • never storing full card details. Payments are handled by Whop;
  • limiting access to people who need it to provide the service;
  • using strong passwords and two-step verification on our accounts; and
  • using reputable service providers with strong security practices.

No system is completely secure, but we work to keep your information safe and review our practices regularly.

12. How long we keep it

  • Client account and billing records are kept while you are a client, and then for as long as required by law. For example, tax records are generally kept for at least 5 years.
  • Caller information is kept while the client’s subscription is active, so they can see their message history. It is deleted or de-identified within 90 days after the subscription ends, unless the law requires us to keep it.
  • Opt-out records are kept for as long as needed to make sure opted-out numbers are not messaged again.
  • Enquiries from people who don’t become clients are deleted within 2 years.

When we no longer need information, we delete or de-identify it.

13. Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, or ask us to correct it, by emailing MisfloAI@gmail.com. We will respond within 30 days. We may need to confirm your identity first. If we can’t give you access or make a correction, we will explain why in writing, unless it would be unreasonable to do so.

If you are a caller and your request relates to information held for one of our clients, we may refer it to that client or work with them to respond.

14. Data breaches

If there is a data breach that is likely to result in serious harm, we will notify the people affected and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme, and take steps to contain it and reduce any harm. Where a breach affects a client’s callers, we will also tell the client promptly.

15. Complaints

If you have a concern about how we have handled your personal information, please contact us first at MisfloAI@gmail.com or on 0411 919 238. We will acknowledge your complaint within 2 business days and aim to resolve it within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

16. Changes to this policy

We may update this policy from time to time, for example if we change how the service works or use a new service provider. We will post the updated policy on this page with a new “last updated” date, and tell clients by email about any significant changes.
